Terms of Use
1. Purpose
These Terms of Use (the “Terms”) govern access to and use of the PimsLead platform (the “Platform”) published by OPIIM SARL. The Platform provides a B2B SaaS, AI-powered leadership-training service, comprising a web back-office for administrators and a mobile application for end users.
The Platform is reserved exclusively for the staff of organisations that have signed a licence agreement with OPIIM SARL.
2. Accounts and access
2.1 Administrators
Administrators (super admin, organisation admin, department admin) access the back-office via a magic link sent by email or a one-time passcode (OTP). Each administrator is responsible for keeping their authentication factors confidential.
2.2 End users
End users access the mobile application anonymously by means of a unique access code provided by their organisation. The code is personal: it may not be shared, sold or transferred. Each access code is intended for a single person, identified by the client organisation.
End users may link a reasonable number of devices to the same account through the device-linking mechanism. A recovery key is generated on first login and must be kept in a safe place; it is the only means of recovering the account if all devices are lost.
3. Acceptable use
Users undertake to:
- Use the Platform in accordance with applicable law, professional ethics and their organisation's policies.
- Not introduce malicious code, attempt unauthorised access, perform bulk data extraction, misuse the AI agents, or impair the security or integrity of the Platform.
- Not impersonate another user and not share their credentials or access code.
- Treat the AI agents (Scriptwriter, Character, Coach) as training tools: their responses are indicative and do not replace the judgement of a qualified professional.
- Not submit to the AI any personal data of identifiable third parties, company confidential information beyond what the training requires, or any unlawful, defamatory, harassing or public-order-infringing content.
OPIIM SARL reserves the right to suspend any account in the event of a breach of these obligations, without prejudice to the client organisation's contractual rights.
4. Intellectual property
All elements of the Platform are protected by intellectual property law. Users are granted a personal, non-transferable, non-exclusive right of use for the duration of their access. No licence over the source code, the scenario library, the prompts or the trademark is granted under these Terms.
Content created by users (free-text answers, feedback) may be used by OPIIM SARL in anonymised form to improve the service.
5. Availability and maintenance
OPIIM SARL uses the necessary means to ensure the availability of the Platform 24/7, without any guarantee of uninterrupted access. Maintenance operations may temporarily restrict access; significant scheduled maintenance will be announced via the back-office.
6. Personal data
The processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms.
7. Liability
The Platform is provided “as is”. OPIIM SARL's liability is limited to direct and foreseeable damage resulting from a proven breach of its contractual obligations and is capped, in any event, by the contractual terms agreed with the client organisation.
OPIIM SARL shall not be liable for indirect damage (loss of opportunity, loss of data, reputational harm) or for damage resulting from non-compliant use of the Platform or from decisions taken on the basis of AI-generated content.
8. Termination
Access to the Platform ends automatically upon expiry of the licence agreement with the client organisation or in the event of a serious breach of these Terms. End users' anonymous data is then handled in accordance with the Privacy Policy.
9. Changes
OPIIM SARL may amend these Terms. The updated version is published in the back-office and on the website with a revised date. Continued use after publication of an update constitutes acceptance.
10. Governing law and jurisdiction
These Terms are governed by French law. Any dispute shall be brought before the competent French courts.
